Terms and Conditions for iWork Freelance

This document constitutes a legally binding agreement between Freelancers, Clients, Students, Tutors, and Meclon Tax & Consultancy Limited, trading as "iWork Freelance," governing the use of the iWork Freelance site and services by users. By clicking "accept" when prompted on the site, users agree to be bound by all agreements that constitute iWork Freelance's Terms of Service.

2. Acceptance of Terms

By accessing or using iWork Freelance, you agree to comply with and be bound by these Terms and Conditions. If you do not agree, you must not use our services.

3. Services Offered

iWork Freelance serves as a platform connecting Clients with Freelancers and Tutors, enabling users to post projects, submit proposals, negotiate terms, and facilitate payments. iWork Freelance is not a party to the agreements between Clients and Freelancers or between Students and Tutors.

iWork Freelance may charge service fees on transactions, which will be clearly disclosed prior to any agreement. Fees are subject to change, and users will be notified accordingly.

6. Confidentiality and Privacy

Users must maintain the confidentiality of sensitive information shared during engagements. iWork Freelance collects, uses, and protects personal information per the Kenya Data Protection Act. Please refer to our Privacy Policy for details.

7. Intellectual Property

All content on the iWork Freelance platform, including text, graphics, and software, is owned or licensed by iWork Freelance and is protected by copyright and intellectual property laws. Unauthorized use, reproduction, or distribution of any content is prohibited.

8. Limitation of Liability

iWork Freelance provides a platform for user connections but is not liable for any direct or indirect damages arising from platform use, including loss of profits or goodwill.

9. Dispute Resolution

Users must first attempt to resolve disputes informally. If unresolved, disputes will be referred to mediation or arbitration under Kenyan law. If necessary, they may escalate to Kenyan courts.

10. Governing Law

These Terms and Conditions are governed by Kenyan law. Disputes will fall under the jurisdiction of Kenyan courts.

11. Amendments

iWork Freelance reserves the right to modify these Terms at any time. Users will be notified of significant changes, and continued use of the platform indicates acceptance of the new terms.

12. Termination

iWork Freelance may suspend or terminate a user's account for violations of these terms, fraudulent behavior, or conduct harmful to the platform or users. Users may terminate their account at any time by notifying iWork Freelance.

13. User Account and Services

14. No Employment Relationship

Nothing in this agreement creates an employment, agency, or joint venture relationship between iWork Freelance and users. iWork Freelance does not supervise users in fulfilling their contractual obligations.

15. Taxes and Benefits

Users are responsible for their own taxes and any benefits that may apply in relation to services provided through the platform.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms constitute the entire agreement between users and iWork Freelance concerning the use of the platform.

18. Force Majeure

iWork Freelance is not liable for any failure to perform its obligations due to circumstances beyond its reasonable control.
